Hey! Is that Sam Spade on my Trail? Can Insurance Companies Hire Private Investigators to follow you?

Personal Injury

Being in an accident that leads to a personal injury claim or litigation can definitely impact your life.

It can take a toll on you both emotionally, physically, and financially.

It may also affect your everyday life.

A personal injury claim may change what you post about on social media.

It may also mean that you are being followed as you go about your daily activities.

How can that be?

It happens because personal injury claims invariably involve insurance companies.

And insurance companies can, and will, follow you to investigate the legitimacy of your claim.

Insurance companies and Investigations

If you have a personal injury claim or action, you need to keep this in mind: insurance companies are in the business of making money. To do that, they try to deny claims or pay out as little as possible on any insurance claim. This is one of the reasons why you should never try to negotiate your personal injury claim alone.

But they need a reason to deny or devalue a claim. So, they spend time and money looking for one.

Insurance companies hire private investigators to look into the background (including criminal records if any) and injury claims of personal injury victims.

Private investigators or insurance claim adjusters can monitor your social media posts.

A private investigator can follow you and take pictures of you in public places (like the grocery store or gas station).

They can also access your public records to look for information that might discredit you or reflect poorly on your credibility. For example, if you have filed a number of personal injury actions before, you might be discredited as a “career plaintiff.”

What should you do?

If you are a plaintiff in a personal injury action or have made a claim for severe injuries, it is critical that you do not exaggerate your injuries. Make sure you follow doctor’s orders. Be mindful of what you post on social media, and always be truthful.

If you have any concerns, be sure to consult an experienced personal injury lawyer.
